There might be an argument for diminished responsibility in this case.
Pity, I believe that drug abusers should carry the full responsibility of their actions.

So let's get this straight. You're hoping one son did it because the other son dissed South Africa?

It's like the Oscar Pistorius trial: criminal justice as an opportunity for nationalistic dick-waving, in which the most desirable outcome is the one that causes your country the least embarrassment.

I wish it never happened but it did. The Aussie newspaper suggested that it happened in SA because it is SA...I get tired of that angle always being played. I just want it to be corrected that in this case, if it turns out to the son, it happened because of a drugged up kid, not because SA is a violent hell hole.

The reason we're joking about the Aus Times' empty headlines is because there's isn't such a newspaper. Not an auspicious sign.

I could be wrong though. There are plenty of newspapers.

There is a facebook post that has been doing the rounds for some time, which is a copy paste from an article in the London Times, in which genocide of whites in SA is proven beyond doubt.

Upon some very easy google investigation, it was discovered that there is no "London Times". The article was fabricated as right wing populist propoganda and used to scare monger.

Does that clear it up?

Tik twist in Stellenbosch axe murder case

Police believe Henri was addicted to the drug tik and would need his records to substantiate their suspicions.

Henri, 20, and his sister, Marli, 16, survived the axe attack on January 27 that killed father Martin, 54, mother Teresa, 55, and elder son Rudi, 22. Marli is recovering in hospital from severe head and neck wounds. Henri suffered only light injuries - these are now believed to have been self-inflicted.

Police are investigating several possible motives for the killing. One of these is that Henri's parents had cut off his allowance.

This week, the Sunday Times tracked down a man who claimed to have been Henri's drug runner.

The young man lives in a shack at the edge of Kreefgat, Jamestown, a small informal settlement barely 200m from the upmarket De Zalze golf estate where the Van Bredas lived and were killed.

The runner, who said his name was Mark, identified Henri (below) from a photograph and said that although he did not know his name, he knew him as a regular customer.

"He started coming here a couple of months ago, sometimes by himself, and sometimes with a friend. They drove a motorbike," said Mark.

"He would give me between R40 and R200 at a time. Then I would go and get his drugs from the dealer. He bought tik, and from another dealer in Jamestown he bought dagga."

Mark, who did not supply drugs but put customers in touch with suppliers, said he hadn't seen Henri for the past three weeks.

Police have not taken a statement from Mark. Sources close to the investigation said this was not necessary because Henri's medical records would be subpoenaed to prove addiction.

Tik is an extremely addictive drug that is cheap and easily manufactured. It emerged just over a decade ago on the Cape Flats and has spread like wildfire. The drug, also known as crystal meth, lowers inhibition, sharpens the senses and fuels aggression. It has devastating social consequences, with addicts usually turning to crime to fund their habit.

Henri reportedly spent time at an upmarket mental health and drug rehabilitation centre in Loevenstein, Bellville, last year.

The centre will also have the results of blood and toxicology tests conducted on the morning of the killings.

Sources last week confirmed that a doctor had found the cuts and bruises on Henri's arms were self-inflicted and that he had called emergency services more than four hours after the attack.

axe

This week, further details of that call emerged. During the call - leaked to the media days after the incident - a calm Henri can be heard telling operators he and his family were "attacked by a guy with an axe".

He then said he was in the toilet when the attack started and that he was the last one attacked. He said the intruder "threw the axe" at him, and that he passed out while being assaulted. He said he called for help when he regained consciousness. At one point during the call he can be heard giggling nervously.

A spokesman for the Van Breda family, Ben Rootman, refused to comment on Henri's alleged drug addiction and treatment. "The family is supporting Henri. He is receiving counselling and is being monitored," said Rootman.

He did not elaborate on the type of counselling or the reason for the monitoring.

Rootman did confirm the appointment of lawyers to assist Henri - advocates Lorinda van Niekerk and Pieter Botha.

Asked about Marli's state of health, Rootman said: "Marli has a complete medical team looking after her physically and emotionally. The family has total trust in this medical team, and they understand that whatever is done at the moment is done with her best interest in mind.

"Last week she was still critical. This week, I am happy to report that she is stable and improving as we speak."

When asked about reports on Henri and a possible plea, Rootman warned that it was reckless to speculate about the police investigation.

"The law must be allowed to follow its course. They must be allowed to do a proper investigation," he said.

This is case is the perfect example what drugs can do to a family. Parents that never understood that sometimes you have to be cruel to be kind to your precious kids. Kids that never take no for an answer. I feel sorry for families that have a druggie family member that rip the family apart.

I'm pretty sure discipline for this kid has been a problem since he was very young. That should have been nipped in the bud early.

Some people are just born psychopaths.

Reminds me of the kid in the States that shot his parents and invited his girlfriend over forcing her to stay the night with the dead parents in the house, before fleeing to Jamaica. He wasn't on drugs or anything iirc.

Just pure evil...

Heart eating cannibal declares 'I am the king'

Image

CAPE TOWN - Policemen called out to a murder scene in Gugulethu, Cape Town who encountered a man eating the heart of his alleged victim with a knife and fork on Tuesday night are receiving counselling.

Western Cape deputy police Commissioner Sharon Jephta said: “It was very gruesome. We had to debrief our members and offer them support and put a further support system in place for them. We did that with those who were present in the house as well.”

Police were called out to the house in Malunga Park at about 10.30pm on Tuesday by a neighbour who had been woken by a commotion.

"On the scene they found a suspect, a Zimbabwean, eating the heart of a human with a knife and fork," said Western Cape police spokesman Captain Frederick van Wyk.

"[The police] were informed that the victim had been stabbed on the left side of his chest and in his neck, and had a bite mark on the right side of his face."

It is believed that the alleged murderer is the ex-lover of Nomonde Soloshe, a woman described as being in her fifties, the owner of the upmarket house where the murder happened and who drives a Mercedes Benz. The victim was her current boyfriend, Mbuyiselo Manona and the couple had been together for more than four years.

According to a report in The Times newspaper, a neighbour, who did not want to be named, said the man who raised the alarm rented a room at the back of Saloshe’s house. He said the former boyfriend had been hired to install windows at the house.

"When we got there the man kept muttering 'I am the king' and declaring his undying love for the woman. He then cut the heart out and ate it before the police came and took him away," the neighbour told The Times.

This is the second time Soloshe’s lover has been murdered. She was married to Camps Bay businessman Bhekizulu Zulu, who in April 1996 discovered she was having an affair and instructed his attorney to start divorce proceedings and changed his will to exclude her.

On 2 June 1996 he was shot twice in the head by her then-lover Xolani Hobongwane – a day before he was scheduled to sign his new will. Zulu’s bodu was found two days after his murder, stuffed in the boot of his car which was parked at Cape Town International Airport. Soloshe was never implicated in the murder.

The murder suspect will appear in court soon.

Actually, the Times, the one published in London, is often known outside the UK (and in the US in particular) as the 'London Times'. So there is such a newspaper. Whether or not it printed that story I don't know.

There is no newspaper that is known as the 'Australian Times' either inside or outside Australia.

http://verburg.co.za/van-breda-family-m ... oxication/

Van Breda family murders. Spotlight on the defence of intoxication.

03.02.2015

With everybody talking about the tragic Van Breda family axe murders the spotlight is once again on criminal law and the elements of a crime, especially that of murder. There is some speculations in the media about the health of the surviving Van Breda son, Henri van Breda. These speculations (emphasis on speculations) include that Henri van Breda is suspected of being a tik addict.

The question arises that what will happen if someone is accused of murder, but that person alleges that he/she was under the influence of drugs, therefore, intoxicated while committing the murder. Intoxication resulting from the use of drugs may play a role in various elements of the crime of murder. Intoxication may have an effect on the criminal capacity (the ability to understand the wrongfulness of his conduct and the ability to conduct himself in accordance with such appreciation of the wrongfulness of his conduct-thus to understand the difference between right and wrong) and culpability (this is where negligence and intent plays a role).

Intoxication resulting from the use of drugs can be involuntary or voluntary. Involuntary intoxication is where someone is, for example, forced to swallow drugs or forced to smoke tik. Another scenario is where someone secretly puts a sedative or drug in your coffee and as a result you become intoxicated, because of that strange tasting coffee. Involuntary intoxication is a defence on a charge of crime committed during the intoxication.

Voluntary intoxication can have different results in a court case. Firstly if a person takes/smoke/injects drugs to gain confidence to commit a crime, then the intoxication will not amount in a defence, in fact it will be a ground for imposing a heavier sentence.

Intoxication leading to mental illness- certain forms of mental illnesses may be the result of chronic consumption of drugs. The accused will then be found not guilty, because of the mental illness, and the court can issue an order that the accused be detained and treated in a psychiatric hospital.

But first, before we speculate, let’s see what happens….

Cell phone used to search Axe Murders before Van Breda Murders
A cell phone that police can connect to the Van Breda’s was used to search information about an Axe Murder that took place in 2004.
The Axe murder searched was about Peter en Joan Porco who was attached by their son Christopher Porco in November 2004 in Bethlehem, America.

His father died but his mother survived but her face was permanently disfigured.

Netwerk24 reported two police sources confirmed of the cell phones and computers inspected by forensics, on one of the cell phones evidence of the Porco attack search was found.

The police and Ben Rootman, the family spokesman, refused to comment as it is still part of the investigation.

Christopher Porco is a convicted murderer, currently imprisoned for killing his father and attempting to murder his mother with a fireman’s axe. He was tried in Orange County, New York, on charges of second-degree murder in the murder of his father, and second-degree attempted murder in the severe wounding and disfigurement of his mother, in Bethlehem, New York.[1]

The case was the subject of a one-hour documentary on 48 Hours Mystery entitled “Memory of Murder”, broadcast by CBS in 2006, as well as an episode of the TruTVseries Forensic Files that aired in 2009. Joan Porco maintained her son’s innocence throughout the trial.
