as for the internet, I don't know whether it exists currently, but I think in future, schools are going to have to devote time to explaining to kids how much damage can be done online, to yourself and to others.

it's a shame that some have had to learn the lessons for others.

My solicitor mate emigrated to NZ in '99 and switched career as a journo. In his next trip back up in '05 he told a work story and the name R o w a n Q u i n n came up. When my discreet probing failed miserably (by this time my ex-wife and his Doris - who always thought I was a perverted sociopath - were decidedly 'WTF??') I told the whole QP story.

The girls didn't believe a word of it, but Richard thought there might be a piece in there for his Radio NZ show.

The issue with legislation like this on the interweb is where is the contract held?

e.g. the servers are in Cape Town, the poster is in America, the other poster (say there was one) was in India, and the managing team are in UK but the Ltd Co that covers all are in the Caymans.

Oh it's far more than that. There's data portability. There's data transfers - personal data is clearly being transfered outside of the EEA. There are marketing consents. How's your privacy policy. It's going to be a nightmare and the ICO ain't going to be fûcking around. 4% of global revenue max fine. They'll expect PR to have its shit in order - to know who the data controllers and processors are - and ignorance will not be an excuse.

It's going to be carnage out there. Especially in the charity sector.


Oh I think we'll be able to handle that with a quick whip round.

It's all about the adtech. Until someone finds out how to do proper attribution. Hopefully the GDPR will put a lot of the adtech to death.

Had a workshop on this at work yesterday and the right to be forgotten is much more narrow and limited than many think. From the ICO

Quote:
The right to erasure does not provide an absolute ‘right to be forgotten’. Individuals have a right to have personal data erased and to prevent processing in specific circumstances:

Where the personal data is no longer necessary in relation to the purpose for which it was originally collected/processed.

When the individual withdraws consent.

When the individual objects to the processing and there is no overriding legitimate interest for continuing the processing.

The personal data was unlawfully processed (ie otherwise in breach of the GDPR).

The personal data has to be erased in order to comply with a legal obligation.

The personal data is processed in relation to the offer of information society services to a child.

Under the DPA, the right to erasure is limited to processing that causes unwarranted and substantial damage or distress. Under the GDPR, this threshold is not present. However, if the processing does cause damage or distress, this is likely to make the case for erasure stronger.


The key point here is legitimate interest which kind of means anything the business would normally do. The interlinking point is around consent. Data can be processed without consent under legitimate interest, so if the company collects your personal data without consent for a legitimate interest purpose then it doesn't have to delete the data if that legitimate interest is ongoing and none of the other reasonside about are in play.
